The court found that the applicant provided a reasonable explanation for the delay in filing the application for stay of execution and leave to appeal out of time, attributing it to a change of advocates and late communication of the judgment to the insurer. The court held that the applicant is entitled to pursue his appeal and that the delay was excusable. To balance the interests of both parties, the court ordered that the decretal sum be deposited in court or a joint account within sixty days, thereby granting stay of execution on condition.
