The court held that the consent entered into between the plaintiff and the 2nd and 3rd defendants (administrators of the estate of the deceased 2nd defendant) was freely made, did not admit any fraud or illegality, and did not prejudice the 1st defendant's ability to defend his case regarding his own title. The court found no basis to reject the consent, as it pertained only to the parcel registered in the name of the deceased 2nd defendant and did not affect the 1st defendant's defence or title. The court therefore adopted the consent as an order, allowing the suit to proceed against the 1st defendant in the ordinary manner.
