Furthermore, the Respondent did not follow the mandatory procedural requirements under Section 41 of the Employment Act, 2007, as the Claimant was not afforded an opportunity to be heard or to have a representative present during the disciplinary process. The dismissal was therefore both substantively and procedurally unfair.
