Ratio Decidendi

The court found that the claimant's resignation was unequivocal and effective upon notice, regardless of the respondent's purported rejection. The employment relationship ceased upon resignation, depriving the respondent of authority to continue disciplinary proceedings or to terminate the claimant thereafter. The subsequent termination letter was therefore null and void, having no legal effect. As there was no valid termination, claims for unfair dismissal, compensatory damages, notice pay, and severance pay could not be sustained. The claimant was, however, entitled to a certificate of service. Each party was ordered to bear its own costs.
