Legal Issues
- 1 Whether the applicant is entitled to resentencing in the absence of lower court proceedings and disclosure of the offence and sentence imposed.
Ratio Decidendi
The court found that the application for resentencing was unsupported because the applicant failed to provide the lower court proceedings, did not disclose the actual offence for which he was convicted, and did not indicate the sentence imposed. The absence of these critical documents and information rendered the application fatally defective. The court held that for a resentencing application to be considered, it must be accompanied by testimonials from prisons, lower court proceedings, and evidence of whether an appeal was filed and its outcome. Without these, the court could not properly assess the merits of the application, leading to its dismissal.
Court Disposition
application dismissed
Orders
- The application for resentencing is dismissed.
- The convict may file a fresh application accompanied by testimonials from prisons, lower court proceedings, and evidence of appeal and its outcome, if any.
