The court held that a chamber summons filed under Paragraph 11 of the Advocates Remuneration Order, being the prescribed mode of challenging a taxing master’s decision, is a pleading capable of amendment. The amended chamber summons dated 6th December 2023 substituted the original application dated 29th November 2023. As pleadings had not closed, the applicant was entitled to amend without leave and serve the respondents. Accordingly, only the amended chamber summons was capable of being withdrawn. The oral application to withdraw the amended chamber summons was allowed, and the application was marked as wholly withdrawn with each party to bear their own costs, as the substantive dispute...
