Ratio Decidendi

The court found that since there was a pending application for review in the lower court, it would be improper for the appellate court to entertain an application for stay of execution on the same matter. Allowing both courts to deal with the same issue simultaneously would lead to a conflict of jurisdiction and undermine the orderly administration of justice. Therefore, the application for stay of execution was disallowed on the basis that two courts cannot be called upon to deal with the same matter at the same time.
