Procedural Posture

Miscellaneous Application / Ruling on Application to Introduce Additional Witness

  1. 1 Whether the respondent should be allowed to introduce a new witness and witness statement after the claimant has closed his case.
  2. 2 Whether admitting the new evidence would prejudice the claimant or alter the proceedings unfairly.

Ratio Decidendi

The court found that the respondent had ample opportunity to identify and present all relevant witnesses, including Mr. Henry Nyabuto, during the pretrial and trial stages. The respondent had already selected and called its witnesses, and the claimant had closed his case based on the pleadings and witness statements on record. Allowing the introduction of a new witness at this late stage would fundamentally alter the proceedings, potentially prejudice the claimant, and disrupt the orderly conduct of the trial. The respondent failed to provide reasonable grounds for not presenting Mr. Nyabuto earlier. The application was therefore dismissed for lack of merit.

Court Disposition

application dismissed with costs

Orders
