Ratio Decidendi

Where a certificate of taxation has not been set aside or altered and there is no dispute as to retainer, the court is empowered to enter judgment for the taxed amount in favour of the advocate. The applicant established that the bill of costs was taxed and a certificate issued, and the respondent did not contest the application or the retainer. The court found no reason to deny judgment. Regarding interest, the court applied the statutory rate of 14% per annum from 30 days after the date it deemed the bill of costs served, as there was no evidence of actual service date. The application was therefore allowed in full, with judgment for the taxed sum, interest, and costs of the application...
