Ratio Decidendi

The High Court found that the trial magistrate correctly assessed liability based on the evidence, particularly the unchallenged police abstract which attributed blame to the appellant. The appellant failed to provide evidence to support his claim of being a good Samaritan or to rebut the respondent's case. On the issue of quantum, the court held that the award of Kshs. 1,000,000 in general damages was excessively high compared to awards in similar cases involving amputation of toes. The court therefore upheld the finding on liability but reduced the general damages to Kshs. 400,000, maintaining the award of special damages and granting half costs to the respondent.
