The court found that the claimant was unfairly dismissed because the Judicial Service Commission failed to accord him a fair hearing after the Human Resource Management Advisory Committee recommended his reinstatement. The Commission did not provide the claimant with documentary evidence relied upon, nor did it give reasons for departing from the committee's recommendation. The disciplinary process was therefore procedurally flawed and in contravention of statutory and constitutional requirements for fair hearing and fair administrative action.
