Legal Issues
- 1 Whether the sentence of 8 months imprisonment for stealing a motorcycle was appropriate in the circumstances.
- 2 Whether the sentence should be revised to a non-custodial sentence given the recovery of the motorcycle and the applicant's mitigation.
Ratio Decidendi
The court found that the sentence of 8 months imprisonment was excessive in the circumstances, considering the recovery of the motorcycle, the applicant's mitigation as a sole breadwinner, and the absence of a presentence report. The court exercised its revisionary jurisdiction to substitute the custodial sentence with a non-custodial sentence of community service for 3 ½ months at the nearest Chief’s Office.
Court Disposition
Sentence revised from 8 months imprisonment to 3 ½ months community service.
Orders
- The convict Calvin Oduor Onyango shall be released from prison to serve unpaid Community Service at the nearest Chief’s Office for 3 ½ months.
