Ratio Decidendi

The High Court lacks jurisdiction to revise or review a sentence imposed by a judge of concurrent jurisdiction. The revisionary powers under Article 165 of the Constitution and Section 362 of the Criminal Procedure Code are expressly limited to orders from subordinate courts and tribunals. Entertaining such an application would amount to the court sitting on appeal over its own decision, which is both unconstitutional and illegal. The applicant's only lawful recourse is to file an appeal against the sentence, not to seek revision before the same level of court.
