The Employment and Labour Relations Court lacks jurisdiction to entertain a reference challenging the taxation of party and party costs arising from an order of the Court of Appeal. The proper procedure, as set out in rules 111 and 112 of the Court of Appeal Rules, 2010, requires that any party aggrieved by the Registrar's decision on party and party costs must refer the matter to a single Judge of the Court of Appeal, who may determine the matter or refer it to a full bench. The ELRC is not vested with jurisdiction to adjudicate such references, and any objection to the Taxing Master's decision in this context must be addressed within the appellate court's own procedures.
