The court found that the notice to show cause for dismissal for want of prosecution was issued in error because less than one year had elapsed since the last action towards prosecution, which was the return of the matter to court after failed mediation on 28th March, 2022. Rule 16 of the Employment and Labour Relations Court Rules prohibits dismissal for want of prosecution within one year of the last prosecutorial action. The affidavits filed by both parties were considered, but the statutory rule was determinative.
