Ratio Decidendi

The court found that the judgment delivered was a negative order, as it simply dismissed the plaintiff's suit with costs and did not require any party to do or refrain from doing anything. Such negative orders are not capable of being stayed, as there is nothing to execute except for costs, which are also not subject to stay. The court adopted the reasoning in George Ole Sangui & 12 others v Kedong Ranch Limited, holding that a dismissal order cannot be enforced and is not capable of execution. Consequently, the plaintiff's application for stay of execution pending appeal was without merit and was dismissed with costs to the defendants.
