Procedural Posture

Notice of Motion / Ruling on Application for Extension of Time to File Notice of Appeal

  1. 1 Whether the defendant has shown good and sufficient cause for extension of time to file a Notice of Appeal against the judgment delivered on 26th January 2023.
  2. 2 Whether lack of notice of judgment delivery constitutes a reasonable excuse for delay in filing the Notice of Appeal.

Ratio Decidendi

The court found that the defendant was not served with notice of the date for delivery of the judgment and there was no evidence that any party was present when the judgment was delivered. In the absence of such notice, the defendant could not have known when the judgment would be delivered, and thus could not file a Notice of Appeal within the prescribed time. The court was satisfied that the defendant had provided a reasonable excuse for the delay and had acted without unreasonable delay upon learning of the judgment. Therefore, good and sufficient cause was established to warrant the exercise of the court's discretion to extend the time for filing the Notice of Appeal.

Court Disposition

Application allowed. Time to file Notice of Appeal extended.

Orders

  • Time within which the defendant is to file a Notice of Appeal is extended up to 16th November 2023.
  • Each party shall bear its own costs.
