The respondent failed to provide credible evidence of a tenancy arrangement or rent payments, and did not take steps to remove the applicant after he attained majority. The court held that the applicant satisfied all legal requirements for adverse possession under Kenyan law, and that the respondent's title was extinguished by operation of law.
