Ratio Decidendi

The judge determined that, having previously confirmed the grant of letters of administration in the underlying succession cause, it would not be in the best interests of justice or in accordance with the right to a fair hearing for him to continue presiding over the appeal. To avoid any appearance of bias and to uphold the integrity of the judicial process, the judge recused himself and ordered the transfer of the appeal, together with the original succession cause record, to the Migori Environment and Land Court for further orders and determination.
