The High Court lacks jurisdiction to grant leave to appeal out of time directly against a surcharge order of the Commissioner for Co-operative Development where the Applicants failed to first appeal to the Co-operative Tribunal as required by Section 74 of the Co-operative Societies Act. The statutory scheme mandates that an aggrieved party must first appeal to the Tribunal within 30 days of the Commissioner's order, and only thereafter may a further appeal on matters of law be made to the High Court within 30 days. The Applicants' failure to utilize the Tribunal process within the prescribed time extinguished their right to challenge the surcharge order before the High Court....
