The court found that while the Defendant, a State Corporation, demonstrated financial hardship and inability to comply with the original order for a Kshs 30,000,000.00 bank guarantee, the interests of the Plaintiffs as successful parties must also be protected. The court recognized its jurisdiction to review its orders upon sufficient cause being shown, particularly hardship. Considering the Defendant's financial position, the existing cash deposit of Kshs 5,000,000.00, and the need to avoid unduly prejudicing the Plaintiffs, the court exercised its discretion to reduce the required bank guarantee to Kshs 10,000,000.00 or a cash deposit of the same amount, to be provided within 60 days....
