The High Court found that the injuries sustained by the respondent were soft tissue in nature and healed without complications. The trial magistrate's award of Kshs 500,000 in general damages was inordinately high and not supported by the nature of the injuries or comparable awards in similar cases. The trial court failed to interrogate the authorities cited and did not provide reasons for the high award. The appellate court held that there was every reason to interfere with the award, setting it aside and substituting it with Kshs 100,000, subject to 10% liability, as a reasonable estimate for the injuries suffered.
