The court found that the applicant failed to establish substantial loss as required under Order 42 Rule 6 of the Civil Procedure Rules, since the mere fact that execution may be put in motion does not amount to substantial loss. The application was, however, filed without undue delay. The applicant did not offer any security for due performance of the decree, which is a mandatory requirement. The court, in balancing the interests of both parties and to avoid rendering the intended appeal nugatory, granted a conditional stay of execution: the applicant must pay 50% of the taxed costs to the respondent within forty-five days, failing which the stay will lapse.
