Ratio Decidendi

The court found that the applicant had rendered legal services to the respondent, the Advocate-Client Bill of Costs was taxed at Ksh. 9,356,653.13, and a Certificate of Taxation was issued. The respondent did not contest the application or challenge the Certificate of Taxation. There was no dispute as to retainer or the amount taxed. Under Section 51(2) of the Advocates Act, the court has discretion to enter judgment on an unchallenged Certificate of Taxation. The court exercised this discretion and entered judgment for the applicant in the sum certified. The claims for interest and further costs were declined as the proceedings were not opposed.
