Ratio Decidendi

The court found that the applicant had satisfied the requirements for review under Order 45 of the Civil Procedure Rules by demonstrating that the consent orders were obtained through fraud and misrepresentation by an advocate who lacked authority to act for the applicant. The court held that the consent orders were therefore invalid and should be set aside to allow the suit to be heard on its merits. The absence of any response from the respondents further supported the applicant's case. The court also found that the conduct of the advocate involved contravened the ethical requirements for advocates, justifying the personal award of costs against him.
