The High Court found that the 1st Respondent did not fully repay the loan, as the apparent 'nil' balance in the loan account was achieved by debiting repayments from a current account that itself became overdrawn, creating a new liability. The Appellant was contractually entitled to consolidate the accounts and retain the logbooks as security until all indebtedness was cleared. The 1st Respondent's continued issuance of cheques from an overdrawn account, and its own admission in correspondence, established liability for the overdraft.
