Ratio Decidendi

The Tribunal found that its jurisdiction is confined to controlled tenancies as defined by Cap 301. The lease between the parties expired on 1st August 2021, and the Landlord had communicated an intention not to renew. The Tenant did not oppose the notice or file a reference within the statutory period, nor did it apply for extension of time. The Landlord's refusal to accept rent indicated no intention to continue the tenancy. Consequently, there was no subsisting tenancy relationship at the time of filing, and the reference was filed out of time. The Tribunal therefore lacked jurisdiction to hear and determine the matter, and the Tenant's application was dismissed.
