The court found that the applicant's motion was incompetent because the impugned ruling, arising from a preliminary objection, was not appealable as of right under Section 75(1) of the Civil Procedure Act and Order 43 Rule 1 of the Civil Procedure Rules. Leave to appeal was required but had not been obtained from the trial court. This procedural defect was fundamental and could not be cured by invoking Article 159(2)(d) of the Constitution. Furthermore, the applicant failed to provide a plausible or sufficient explanation for the delay in seeking leave to appeal out of time.
