Sawenja v Republic (Criminal Appeal E125 of 2025) [2026] KEHC 10078 (KLR) (7 July 2026) (Ruling) Neutral citation: [2026] KEHC 10078 (KLR) Republic of Kenya In the High Court at Kibera Criminal Appeal E125 of 2025 DR Kavedza, J July 7, 2026 Between Oscar Barasa Sawenja Appellant and Republic Respondent Ruling 1.The Appellant filed a petition of appeal challenging both the conviction and sentence imposed by the trial court in Kibera Chief Magistrate's Court Criminal Case No. E840 of 2020. Upon considering the appeal, in a judgment delivered on 18th June 2026, this court found the appeal to be devoid of merit and dismissed it in its entirety, thereby affirming both the conviction and the sentence imposed by the trial court. 2.Following the determination of the appeal, there are no pending proceedings requiring the continued subsistence of the bond executed by the surety. Consequently, the surety is hereby discharged from all obligations arising under the bond. The title documents deposited in Court as security shall forthwith be released and returned to the depositor, unless otherwise lawfully held pursuant to any other order of a competent court. 3.This matter is hereby marked as fully concluded and the file is closed.
