Ratio Decidendi

The High Court held that the assessment of Auctioneer's commission on proclamation (item 3) must be based on the single percentage applicable to the total sum as provided in the Auctioneer Rules, not a graduated approach across bands. The lower court was correct in this respect, and the Appellant's argument was rejected. However, on item 6, the court found that travel expenses should be calculated from the Auctioneer's office, not the court, as the law requires Auctioneers to maintain a register of instructions at their office and not all instructions originate from courts. The lower court erred in this aspect, and the award for item 6 was set aside and substituted with a higher amount....

Court Disposition

Appeal partly allowed.

  • The award of Kshs. 20,817/= on item 6 of the Bill of Costs is set aside and substituted with Kshs. 38,082.80.
