The Tribunal found that the Applicant had established a controlled tenancy with Ote Stores Limited, evidenced by a duly executed tenancy agreement for three years. The 4th Respondent's silence on the existence of this agreement, despite admitting to letting the premises to George O. Atunga (Ote Stores Limited), supported the Applicant's position as a subtenant. Under Sections 4(2) and 5 of Cap. 301, the Applicant's tenancy could only be terminated by proper statutory notice, which had not occurred.
