Procedural Posture

Stay Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution

  1. 1 Whether the Respondent should be granted leave to file a Notice of Appeal out of time.
  2. 2 Whether an order for stay of execution of the ex parte Judgment should be granted.

Ratio Decidendi

The court found that the Respondent had been afforded adequate opportunity to participate in the proceedings at every stage but chose not to do so. Previous applications for stay had already been granted, and granting further stay or leave to appeal out of time would unjustly prejudice the Claimants' right to timely justice. The Respondent failed to demonstrate sufficient cause for the delay in seeking leave to appeal out of time, nor did it show that it would suffer substantial loss if stay was not granted. The interests of justice required that the matter be brought to a close and the Claimants allowed to enjoy the fruits of their judgment.

Court Disposition

application dismissed
