Consequently, the preliminary objection filed by the said firm was improperly before the Tribunal and was struck out. On the substantive application, the Tribunal held that the Applicants had failed to file an appeal against the surcharge order within the statutory thirty-day period as required by Section 74(1) of the Cooperative Societies Act.
