As a result, the preliminary objection filed by the firm was improperly before the Tribunal and was struck out. On the substantive application, the Tribunal held that the Applicants, having been surcharged and issued with orders in 2016, failed to file an appeal to the Tribunal within the statutory thirty-day period as required by Section 74(1) of the Cooperative Societies Act.
