Procedural Posture

Miscellaneous Application / Ruling on Motion to Adopt Director's Award as Judgment

  1. 1 Does the Employment and Labour Relations Court have jurisdiction to enforce or adopt an award by the Director of Occupational Safety and Health Services as a judgment of the Court?
  2. 2 Was the respondent properly notified of the award and did it have an opportunity to object within the statutory period?
  3. 3 Is the applicant entitled to enforcement of the award, interest, and costs?

Ratio Decidendi

The Employment and Labour Relations Court retains original jurisdiction to enforce awards by the Director of Occupational Safety and Health Services, notwithstanding the delegation of certain matters to Magistrates. The respondent was properly notified of the award and failed to lodge an objection within the statutory 60-day period. The respondent's claim of lack of notice was unsubstantiated, as evidence showed it was aware of the award and had the opportunity to object, including obtaining a second medical opinion. The appellate jurisdiction under section 52(2) of the Work Injury Benefits Act is only relevant where an objection has been made and determined, which was not the case here....
