Ratio Decidendi

The High Court found that the Maseno Law Courts lacked the proper geographical jurisdiction to hear the matter. In the interest of justice and in accordance with the Criminal Procedure Code, the court exercised its discretion to withdraw the file from Maseno Law Courts and transfer it to Kombewa Law Courts, which has the appropriate jurisdiction. The court further directed that the matter be mentioned before the Head of Station at Kombewa Law Court for further directions and ordered the file closed at the High Court level.
