Given the uncertainty and the possibility that the lower court lacked jurisdiction, the Environment and Land Court exercised its supervisory powers to transfer the suit for substantive determination. The court held that the appropriate interim order was to preserve the property by maintaining the status quo, rather than enforcing the lower court's orders for deposit of rent into a joint account.
