  1. 1 Does the High Court have jurisdiction to review its own decision after an appeal has been determined?
  2. 2 Can the period spent in custody pending trial be considered after dismissal of a criminal appeal by the High Court?

Ratio Decidendi

The High Court lacks jurisdiction to review or reopen its own decisions after it has determined an appeal. Once the High Court has heard and determined an appeal, any further challenge to the conviction or sentence must be made to the Court of Appeal. The High Court's supervisory jurisdiction is limited to subordinate courts and does not extend to superior courts, including itself. Therefore, the Petitioner's application to have the period spent in custody pending trial considered after dismissal of his appeal is incompetent for want of jurisdiction and must be struck out.
