Ratio Decidendi

The High Court found that the trial court correctly applied the law and evidence in determining the arrears owed by the appellant for child maintenance and school fees. The appellant failed to provide sufficient evidence of payments made or of any change in his financial circumstances. The trial court’s tabulation of arrears was justified, and the orders for maintenance, school fees, and medical cover were consistent with the best interest of the child as required by law. However, in light of new evidence of payments and the parties’ agreement, the decretal amount was reduced from Ksh 4,129,935 to Ksh 3,000,000, with Ksh 500,000 already paid and the balance to be settled in instalments....

Court Disposition

Appeal allowed in part; decretal amount reduced to Ksh 3,000,000 as agreed by parties; other obligations of appellant maintained.

Orders

  • The appeal is allowed to the extent of reducing the decretal amount to Ksh 3,000,000 with costs to the respondent.
  • The appellant shall settle the balance of Ksh 2,500,000 in monthly instalments of Ksh 100,000.
