The court found that the prior suit (Nakuru Small Claims Court Civil Case No. 218 of 2022) was dismissed solely on the ground of prematurity and not on the merits of the claim. As such, the doctrine of res judicata did not apply to bar the subsequent suit (Nakuru Small Claims Court No. E147 of 2023). The application for stay of proceedings was therefore not merited, as the applicant had not demonstrated exceptional circumstances or prejudice that would justify the exercise of the court's discretion to stay proceedings.
