Even where there is delay, amendments can be allowed if no prejudice is suffered by the other party that cannot be compensated by costs. The court found that the proposed amendments and counterclaim would assist in resolving the real questions in controversy and prevent multiplicity of suits. The court further held that, under Order 8 Rule 3(2), it has discretion to allow amendments even after the expiry of limitation periods if it is just to do so.
