The court found that the subject matter of the original suit and judgment was land parcel NO North Teso/Kamuriai/219, not NO North Teso/Kamuriai/5344, where the burial occurred. There was no evidence that parcel 5344 was a subdivision of parcel 219 or that the court's previous orders extended to it. As such, the court lacked jurisdiction to order exhumation from parcel 5344. Further, the applicant's own evidence showed that the 2nd and 3rd respondents were unaware of any relevant court orders, and the 1st respondent was not subject to any order regarding parcel 5344.
