Ratio Decidendi

The court found that the Respondent failed to justify poor performance as a ground for terminating the Claimant's employment. There was no evidence of agreed performance targets or objective evaluation instruments, nor was the Claimant given sufficient opportunity to improve. The Respondent did not meet the statutory requirements under sections 43 and 45 of the Employment Act. Consequently, the termination was unfair and unlawful. However, considering the Claimant's ability to secure alternative employment and the circumstances, the court limited compensation to five months' salary, in addition to notice pay, costs, and interest.
