Ratio Decidendi

The court found that there was no demonstrated nexus between the respondent and the County of Mombasa, the Ministry of Water & Irrigation, or the Attorney General that would justify their joinder as parties to the proceedings. The respondent, as a company with separate legal personality, was entitled to appoint its own advocate and be sued in its own name. The application to join additional parties was therefore without merit. The court also found no sufficient grounds to stay the proceedings in respect of the bill of costs. Accordingly, the application dated 5th September, 2018 was dismissed with costs, and the taxation of the bill of costs was ordered to proceed before the taxing master.
