Ratio Decidendi

The court held that a proforma invoice delivered by the advocate on 31st October 2017 did not constitute a bill for the purposes of Rule 7 of the Advocates Remuneration Order. The final bill, which triggers the accrual of interest, was only sent under cover of the letter dated 11th December 2019, after the parties had consented to reduce the costs to Kshs 200,000. Therefore, interest on the costs was only payable from 10th January 2020, being 30 days after the delivery of the final bill, and not from 30th November 2017 as claimed by the applicant. The applicant's claim for interest from an earlier date was thus not supported by law or fact.
