The court held that although the retainer agreement between the advocate and client was contrary to the Advocates Act and would ordinarily preclude the advocate from seeking taxation under the Advocates Remuneration Order, the client, through counsel, had expressly consented to the taxation of the bill of costs (except for specific items) and to the entry of judgment in terms of the certificate of costs. This consent was recorded both before the Taxing Officer and the court.
