Ratio Decidendi

The court found that the applicant was entitled to judgment for the taxed costs as per the certificate of taxation, as there was no dispute on the retainer or the amount. Regarding interest, the court held that interest at 14% per annum is awardable from 30 days after the date of service of the bill of costs, in accordance with Rule 7 of the Advocates Remuneration Order. Since there was no evidence of the exact date of service, the court adopted 17.12.15 (the date the respondent entered appearance) as the date of service, making interest payable from 16.1.16. The applicant was also awarded the costs of the application.
