Ratio Decidendi

The court found that the claimant's employment was terminated by summary dismissal effective 23rd March 2016, and the claimant filed the suit on 27th May 2019. Section 90 of the Employment Act, 2007 requires that employment claims be filed within three years of the cause of action. The court held that the limitation period began to run from the date of termination, not from the date of any subsequent appeal or communication. Since the suit was filed more than three years after the termination, it was statute barred. The court therefore lacked jurisdiction to entertain the claim and dismissed the suit without considering the merits of the unfair termination allegations or the reliefs sought.
