The second limb, regarding non-joinder of the Association, was also dismissed as misjoinder or non-joinder of parties is not fatal to a suit and can be remedied by amendment. The applicant had sued the officials in their representative capacities, which is proper for an unincorporated association. Therefore, both limbs of the preliminary objection failed to meet the threshold for a preliminary objection and were dismissed.
