The court held that under Section 51(2) of the Advocates Act, the applicant was entitled to judgment in terms of the certificate of costs. However, the court found that the applicant had not demonstrated that the bill of costs was served on the client prior to filing in court or that a claim for interest at 14% per annum was made before payment or tender in full, as required by Rule 7 of the Advocates Remuneration Order.
